US DOC makes affirmative final determination in AD/CVD case against steel rack imports from China

On July 18, 2019, the US Department of Commerce (DOC) announced its affirmative final determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations of imports of steel racks and parts thereof from China.

The DOC determined a dumping rate of 18.06 percent to mandatory respondent Nanjing Dongsheng Shelf Manufacturing Co., Ltd. A dumping rate of 144.50 percent was determined for the China-wide entity, based entirely on adverse facts available. The DOC determined a dumping rate of 18.06 percent for all other producers and exporters from China that it found to be eligible for a separate rate.

Thee DOC calculated a subsidy rate of 1.50 percent for mandatory respondent Nanjing Dongsheng Shelf Manufacturing Co., Ltd.  Additionally, 16 companies that failed to respond to The DOC’s request for information received an adverse facts available rate of 102.23 percent. The subsidy rate for all other Chinese producers and exporters is 1.50 percent.

 The US International Trade Commission (ITC) is scheduled to make its final determinations on or about September 3, 2019. If the ITC makes affirmative final determinations that imports of steel racks and parts thereof from China materially injure, or threaten material injury to, the domestic industry, Commerce will issue AD and CVD orders.  If the ITC makes negative determinations of injury, the investigations will be terminated.
