U.S. requests a panel to evaluate the EU measures
During the meeting held on August 30, 2002, establishment of a panel in order to rule on the provisional safeguard measures of the European Communities was requested by the US. The basic argument of the US is that these safeguard measures are prepared without making proper investigations to determine the share of the domestic market taken by increased imports, i.e., existence of material injury or the threat of an injury. Furthermore it argues that EU has no grounds to implement such measures without submitting a detailed analysis of the case or a demonstration of the relevance of the factors examined. At the request of the US Government, consultations with the European Communities were held however parties failed to resolve the dispute. Therefore the US now requests the Dispute Settlement Body (DSB) to establish a panel in order to clarify the above mentioned points.U.S. requests a panel to evaluate the EU measures
