CITT to initiate expiry review of findings concerning HR carbon steel plate and high-strength low-alloy steel plate from three countries

The Canadian International Trade Tribunal (CITT) has announced that it will initiate an expiry review of its findings made on January 9, 2004 concerning hot rolled carbon steel plate and high-strength low-alloy steel plates originating in or exported from Bulgaria, the Czech Republic and Romania.

The products under investigation include hot rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot rolled, heat treated or not, in cut lengths in widths from 24 inches (+/-610 mm) to 152 inches (+/-3,860 mm) inclusive and in thicknesses from 0.187 inch (+/-4.75 mm) to 4 inches (+/-101.6 mm) inclusive, excluding plate produced to American Society for Testing and Materials (ASTM) specifications A515 and A516M/A516 Grade 70 in thicknesses greater than 3.125 inches (+/-79.3 mm), universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate).

The CITT has notified the Canada Border Services Agency (CBSA) as well as other government organs about its decision.

In this expiry review, the CBSA is to determine whether expiry of the findings in respect of any subject goods is likely to result in the continuation or resumption of dumping of the goods. If the CBSA determines that the dumping will be continued or reoccur, the CITT will then conduct an inquiry to determine if continued or resumed dumping is likely to result in injury or retardation.

If the CBSA determines that the expiry of the findings in respect to any goods is unlikely to result in the continuation or resumption of dumping, the CITT will not consider those goods in its subsequent determination of the likelihood of injury or retardation and will issue an order rescinding the finding with respect to those goods.

The CITT will issue its order no later than January 8, 2009, and its statement of reasoning no later than January 23, 2009.
