On April 9, 2008, the Canadian International Trade Tribunal (CITT) announced the initiation of the expiry review of its findings made on December 23, 2003 concerning carbon and alloy steel structural tubing, known as hollow structural sections (HSS), imported from South Korea, South Africa and Turkey.
Based on the comments received from the interested persons and governments, the CITT has decided that a review of the order is warranted.
On December 23, 2003, CITT had decided to impose antidumping duties on the subject products imported from South Korea, South Africa and Turkey as follows:
Country of origin | Volume of dumped goods | Margin |
South Korea | 100 % | 89% |
South Africa | 100 % | 55.4% |
67.9 % | 17.5% |
If the Canadian Border Services Agency (CBSA) determines that the expiry of the order in respect to the subject goods is unlikely to result in the continuation or resumption of dumping, the CITT will decide to rescind the order with respect to those goods. If, on the other hand, the CBSA determines that the expiry order in respect to the subject goods is likely to result in the continuation or resumption of dumping, the CITT will then conduct an inquiry to determine if the continued or resumed dumping is likely to result in injury or retardation.
The CBSA must provide notice of its determination no later than August 7, 2008 and the CITT must announce its decision and a statement of its reasons by December 22, 2008.
