US DOC issues preliminary results of sunset review on CTL steel plate from Ukraine

In the scope of the sunset review of the suspended antidumping (AD) duties on certain cut-to-length carbon steel plate (CTL) from Ukraine initiated on August 1, 2008, the US Department of Commerce (US DOC) has preliminarily determined that termination of the suspended AD duties would likely lead to continuation or recurrence of dumping.

Accordingly, the DOC's preliminary set AD margins for the Ukrainian manufacturers, producers, and exporters of the subject merchandise are at the following levels as of November 25, 2008:

Azovstal -- 81.43 percent
Ilyich -- 155.00 percent
Ukraine-wide rate -- 237.91 percent

On November 19, 1997, the DOC had issued notice of final determination of "sales at less than fair value" on certain CTL plate from Ukraine; nevertheless, on September 29, 2008, a revised "suspension agreement" was signed by representatives of the Ukrainian CTL plate producers. The agreement became effective as of November 1, 2008, replacing the previous non-market economy agreement which was in effect since 1997.

According to a notification released in the Federal Register, the DOC will issue the final results of this sunset review no later than March 29, 2009.
