US DOC announces affirmative final circumvention rulings on CORE steel

The US Department of Commerce (DOC) has announced its final affirmative circumvention rulings that corrosion-resistant steel products (CORE) imported from Costa Rica and the United Arab Emirates (UAE) produced from substrate originating in China are circumventing existing antidumping (AD) duty and countervailing duty (CVD) orders on the given product imported from China. However, the DOC determined that CORE exported from Guatemala is not made with Chinese substrate.

As a result, the DOC will instruct Customs and Border Protection (CBP) to continue collecting AD and CVD cash deposits on imports of CORE products produced in Costa Rica and the UAE, with rates of 199.43 percent and 39.05 percent, respectively. These duties will be imposed on future imports, and on any unliquidated entries since August 12, 2019, the date the circumvention inquiries were initiated.

Meanwhile, Costa Rican and UAE-based exporters and producers of the given products that are produced from substrate originating in their countries or a third-country have the option of seeking an exemption from cash deposits by certifying that the substrate originated outside of China.
