Thailand exempts re-exporters from AD duties on HRC
The Ministry of Commerce in
Thailand announced in a royal decree dated December 20, 2002 that importers can get hot rolled coil anti-dumping exemption if they use the material with following purposes:
1) Under Board of Investment (BOI) program
2) Import under export zone and use for making re export product
3) Import for re export under custom regulation
Therefore,
pipe makers are in a position to import HR from AD origins if they use HR coil for making
pipe and re export.
This new decree has come into force as of December 20, 2002.
A short analysis of the situation for the main
pipe makers can be given as follows:
1) SAHATHAI STEEL
PIPE – will benefit from this announcement and will not need to pay anti-dumping tax in advance, since they have bonded warehouse.
2) INTERSTEEL
PIPE (TUS) - will benefit from this new regulation since they also have bonded warehouse.
3) COTCO - will benefit from this new regulation since their factory is under BOI export promotion area and can be exempt from anti-dumping tax.
4) PACIFIC
PIPE - It appears this company will not get benefit since it does not have a bonded warehouse and its factory is not in BOI zone area. It must pay AD duty of 130 % plus import tax of 10% in advance and then it can get refund once they export their
pipe.
They are checking to apply for bonded warehouse to customs department.
However, SteelOrbis understands that Thai companies are currently refusing to consider importing hot rolled coil at prevailing prices and still only want to purchase below $300 C+F basis.
