World Trade Organization (WTO) Dispute Settlement Body has found that the US failed to comply with certain WTO rules regarding the countervailing duties (CVD) against certain pipe products imported from Turkey.
This dispute concerns Turkish imports of certain oil country tubular goods (OCTG); welded line pipe (WLP); and heavy walled rectangular welded carbon steel pipes and tubes (HWRP); and in connection with a 2011 sunset review and 2013 administrative review of the countervailing duty order on Turkish imports of circular welded carbon steel pipes and tubes (CWP).
WTO has said that United States acted inconsistently with WTO rules because the US Department of Commerce failed to apply the correct legal standard and failed to provide a reasoned and adequate explanation for its public body determinations regarding Erdemir and Isdemir.
The US DOC previously determined that certain pipe imports from Turkey were subsidized because the pipe producers purchased hot rolled steel from Erdemir and Isdemir which they described as state-owned institutions.
WTO recommended that the United States bring its measures into conformity with its obligations under the Subsidies and Countervailing Measures Agreement.
