US DOC sets new AD margins in 17th review of Korean flat steel

The US Department of Commerce (DOC) announced Monday the final results of its administrative review of the antidumping (AD) order on corrosion-resistant carbon steel flat products from Korea
 
The review of the antidumping order covered eight producers/exporters--Dongbu Steel Co. Ltd.; Dongkuk Industries Co. Ltd.; Haewon MSC Co. Ltd,; Hyundai HYSCO; LG Chem Ltd.; LG Hausys Ltd.; Pohang Iron & Steel Company Ltd. and its affiliated company Pohang Coated Steel Co. Ltd. (collectively POSCO); and Union Steel Manufacturing Co. Ltd.--during the period from August 1, 2009 through July 31, 2010.  This is the 17th administrative review of this antidumping order. 
 
The DOC selected Dongbu, Hyundai HYSCO, POSCO, and Union Steel for individual review.  It calculated final weighted-average dumping margins of 4.80 percent for Dongbu, 0.25 percent for Hyundai HYSCO, 0.04 percent for POSCO, and 3.66 percent for Union Steel.  The margins for Hyundai HYSCO and POSCO are de minimis. 
 
For the remaining four companies--Dongkuk, Haewon, LG Chem, and LG Hausys--the DOC determined a dumping margin of 4.23 percent, based on an average of the margins for Dongbu and Union Steel.  The DOC did not include the margins for Hyundai HYSCO and POSCO in this calculation because the DOC does not consider zero or de minimis margins when it calculates an average of margins of companies selected for individual review.
 
In addition, the DOC revoked the AD order with respect to POSCO.  The DOC found that POSCO had a zero or de minimis dumping margin during the period of review as well as during the preceding two years.  Further, the DOC found that POSCO sold corrosion-resistant flat products in commercial quantities during each of these years.  Therefore, the DOC revoked the AD order with respect to POSCO, effective August 1, 2010.
 
Accordingly, effective March 12, 2012, the dumping duty deposit rates became (a) 4.80 percent for Dongbu; (b) 3.66 percent for Union Steel; (c) 4.23 percent for Dongkuk, Haewon, LG Chem, and LG Hausys; and (d) 0.00 (zero) percent for Hyundai HYSCO.  The AD order is revoked for POSCO, effective for imports made on or after August 1, 2010.  In addition, the DOC will send instructions to US Customs and Border Protection to liquidate entries that were made during the period of review. 

The flat steel products under this review are characterized under the Harmonized Tariff Schedule of the United States (HTSUS) under item numbers: 7210.30.0030, 7210.30.0060, 7210.41.0000, 7210.49.0030, 7210.49.0090, 7210.61.0000, 7210.69.0000, 7210.70.6030, 7210.70.6060, 7210.70.6090, 7210.90.1000, 7210.90.6000, 7210.90.9000, 7212.20.0000, 7212.30.1030, 7212.30.1090, 7212.30.3000, 7212.30.5000, 7212.40.1000, 7212.40.5000, 7212.50.0000, 7212.60.0000, 7215.90.1000, 7215.90.3000, 7215.90.5000, 7217.20.1500, 7217.30.1530, 7217.30.1560, 7217.90.1000, 7217.90.5030, 7217.90.5060 and 7217.90.5090.
