EU ends anti-circumvention probe on Chinese stainless seamless pipes

The European Commission (EC) has announced that it has terminated the investigation concerning possible circumvention of the antidumping (AD) measures imposed by the commission on imports of certain seamless pipes and tubes of stainless steel originating in China by imports consigned from India, whether declared as originating in India or not, and it has also terminated the registration of such imports.

The investigation was launched upon a complaint received from the defense committee of the seamless stainless steel tubes industry of the European Union, alleging that the antidumping measures on imports of certain seamless pipes and tubes of stainless steel originating in the China were being circumvented via India. The complaint indicated that there was a change in the pattern of trade between India and China and the EU,

According to the commission’s statement, the investigation showed that the allegedly changed practice in question, which is India’s importing hot formed tubes from China and producing and selling cold processed seamless pipes and tubes of stainless steel domestically and for export, was started before the initiation of the original investigation. The investigation also showed that the cold processing represents a substantial transformation of the product and that there is due cause and economic justification other than the avoidance of the duty for any change in the pattern of trade between China, India and the EU.

The products in question currently fall under Customs Tariff Statistics Position Numbers 7304 11 00, ex 7304 22 00, ex 7304 24 00, ex 7304 41 00, ex 7304 49 10, ex 7304 49 93, ex 7304 49 95, ex 7304 49 99 and ex 7304 90 00.
