A Brazilian court in the state of Espirito Santo has decided to maintain $10.5 million (BRL 35 million) in fines imposed on local steelmaker ArcelorMittal Brazil for pollution in the city of Vitoria, where the steelmaker operates ArcelorMittal Tubarao.

The decision was issued as the state court denied a request by ArcelorMittal Brazil to annul five fines amounting $10.5 million.

ArcelorMittal Brazil was fined in January 2016 for polluting the sea and air with a black dust in the region where it operates the Tubarao Port. Other fines were also applied due to the company’s failure to meet the limits set for the emission of a so-called “black dust” in the Vitoria city area.

ArcelorMittal will have the opportunity to appeal the decision to a higher court.
