US DOC announced final results of AD order against corrosion-resistant flat steel products from Korea

On Monday, the US Department of Commerce (DOC) announced the final results of its administrative review of the antidumping (AD) order against corrosion-resistant carbon steel flat products from Korea.

The review of the antidumping order covered eight producers/exporters-Dongbu Steel Co. Ltd.; Dongkuk Industries Co. Ltd.; Haewon MSC Co. Ltd.; Hyundai HYSCO; LG Chem Ltd.; LG Hausys Ltd.; Pohang Iron & Steel Company Ltd. and its affiliated company Pohang Coated Steel Co. Ltd. (collectively POSCO); and Union Steel Manufacturing Co. Ltd. - during the period from August 1, 2008 through July 31, 2009.  This is the sixteenth administrative review of the antidumping order. 
 
The DOC selected Dongbu, Hyundai HYSCO, POSCO, and Union Steel for individual review.  It calculated final weighted-average dumping margins of 3.89 percent for Dongbu, 0.20 percent for Hyundai HYSCO, 0.05 percent for POSCO, and 2.27 percent for Union Steel.  The margins for Hyundai HYSCO and POSCO are de minimis. 
 
For the remaining four companies - Dongkuk, Haewon, LG Chem, and LG Hausys - the DOC determined a dumping margin of 3.00 percent, based on an average of the margins for Dongbu and Union Steel.  The DOC did not include the margins for Hyundai HYSCO and POSCO in this calculation because the DOC does not consider zero or de minimis margins when it calculates an average of margins of companies selected for individual review.
 
These final margins compare with previous dumping duty deposit rates of 8.56 percent for Dongbu, 5.01 percent for Dongkuk, 8.56 percent for Haewon, 3.29 percent for Hyundai HYSCO, 8.56 percent for LG Chem, 17.70 percent ("All Others" rate) for LG Hausys, 0.00 percent for POSCO, and 14.01 percent for Union Steel.
 
Accordingly, effective Monday, March 21, 2011, the dumping duty deposit rates became those indicated above.  In addition, the DOC will send instructions to US Customs and Border Protection to liquidate entries that were made during the period of review.  
 
Previously, in January 2011, the DOC announced the final results of its administrative review of the countervailing duty (CVD) order against corrosion-resistant carbon steel flat products from Korea.  The DOC calculated a final net subsidy rate of 0.05 percent for Hyundai HYSCO, which is de minimis.  Hyundai HYSCO's previous subsidy rate was also 0.00 percent.  The DOC rescinded the reviews of Dongbu and POSCO because those companies had withdrawn their requests for review.  The subsidy rates for those companies remained unchanged - at 0.00 percent.
