On August 2, 2001, the European Commission (EU) imposed antidumping duty on certain iron or steel ropes and cables imported from
Russia.
Imports of subject merchandise from Cherepovetsky Staleprokatny Zavod were subject to a 36.1 percent antidumping duty.
An undertaking was accepted by Commission Decision dated July 26, 2001 from Open Joint Stock Company Cherepovetsky Staleprokatny Zavod (ChSPZ). ChSPZ informed the EC that on January 1, 2006, as a result of a merger with Open Joint Stock Company Orlovsky Staleprokatny Zavod (’OSPAZ') and Closed Joint Stock Company
Severstal-Metiz, it changed its name into Closed Joint Stock Company
Severstal-Metiz (’SSM').
The company argued that the change of name does not affect the right of the merged company to benefit from the undertaking given by the company under its previous name of ChSPZ.
After examining the information provided, the EC decided that the change of name in no way affects the findings dated August 2, 2001. Therefore, the reference to Open Joint Stock Company Cherepovetsky Staleprokatny Zavod should be read as Closed Joint Stock Company
