US ITC issues final ruling on trade secrets case concerning cast steel railway wheels

On February 16, 2010, the US International Trade Commission (ITC) issued its final determination regarding a case about misappropriation of trade secrets concerning certain cast steel railway wheels, processes for manufacturing or relating to same and certain products containing the same.

Ruling in the favor of the petitioner Amsted Industries Incorporated, the ITC issued a 10-year limited exclusion order and 10-year cease and desist orders against four respondents: two Chinese companies (Tianrui Group Company Limited and Tianrui Group Foundry Company Limited) and two US companies (Standard Car Truck Company, Inc and Barber Tianrui Railway Supply, LLC).

The exclusion order prohibits the entry into the US of such cast steel railway wheels and products. The cease and desist orders prohibit all four respondents from, among other things, importing or selling for importation into the US, offering for sale, marketing, selling or distributing in the US and advertising such products.
