The government of Mexico reported that under the trade agreement USMCA, it made a "Request for Review before a Binational Panel" against a resolution of the United States Department of Commerce, at the request of the Mexican Grupo Acerero, due to the high dumping tariff is marginalized from export rebar to that market.
The request is against the "final results of the administrative review of the Department of Commerce of the United States of America on the imposition of Steel Concrete Reinforcing Bar From Mexico: Final Results of Antidumping Duty Administrative Review; 2020-2021," published the Ministry of Economy in the official gazette of the Mexican government (DOF).
At the request of Grupo Acerero, the Mexican government submitted the request on July 6 and today, Monday, August 14, the Mexican government and the US government reported that the first request for panel review has been filed USA-MEX-2023-10.12- 01.
Grupo Acerero, a Mexican rebar producer, was the company hardest hit with the high dumping margin maintained by the Commerce Department of the 14 companies notified.
In the most recent review, the Department of Commerce decreased the dumping margin for the Mexican company DeAcero by 0.19 percentage points to 2.30 percent. For ArcelorMittal México and the 11 companies of Grupo Simec, it decreased by 0.15 percentage points to 5.78 percent.
However, for Grupo Acerero it remained unchanged at 16.28 percent. In other words, the dumping margin of Grupo Acerero is 7.1 times greater than that of DeAcero and 2.8 times greater than the rest of its commercial rivals. With that margin, one expert said, it is out of the US market.
The request of the binational panel comes at a time when some congressmen and companies in the United States want the Section 232 tariffs on steel and aluminum to be imposed again on Mexico, which were eliminated for Mexico in 2019.
