On October 11, 2005, the Canadian International Trade Tribunal (CITT) announced that its order made on August 17, 2001, concerning the dumping of certain flat hot-rolled carbon and alloy steel sheet and strip imported from
Brazil,
Bulgaria,
China,
Taiwan,
India,
Macedonia, South
Africa,
Ukraine, and
Serbia and
Montenegro, and the subsidizing of the same goods imported from
India, would expire on August 16, 2006.
Under the Special Import Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of antidumping and countervailing duties expire five years from the date of the last order of finding, unless an expiry review has been initiated.
Interested persons and governments requesting or opposing the initiation of an expiry review were requested to submit their petitions to the CITT.
As a result of the petitions submitted, the CITT decided that an expiry review was warranted. Accordingly, the
Canada Border Services Agency (CBSA) conducted an investigation to determine whether the expiry of the finding in respect to the subject merchandise is likely to result in the continuation or resumption of dumping and subsidizing of the goods.
As a result of this investigation, the CBSA determined that the expiry of the finding made by the CITT on August 17, 2001, concerning flat hot-rolled carbon and alloy steel sheet and strip imported from
Brazil,
China,
Taiwan,
India, South
Africa, and
Ukraine was likely to result in the continuation or resumption of dumping of the goods into
Canada. Moreover, the CBSA determined that the expiry of the finding was likely to result in the continuation or resumption of subsidizing of certain flat hot-rolled carbon and alloy steel sheet and strip imported from
India.
On the other hand, the CBSA determined that the expiry of the finding was unlikely to result in the continuation or resumption of dumping of the goods into
Canada of certain flat hot-rolled carbon and alloy steel sheet and strip imported from
Macedonia,
Bulgaria, and
Serbia and
Montenegro.
