Vale pays fine for misinformation about safety of collapsed waste dam

Brazilian miner Vale announced the payment of BRL 86.28 million ($17.57 million), after the union general attorney (CGU) rejected Vale’s request to reconsider the conviction published on August 15, 2022.

Vale was accused of not submitting reliable information to the National Mining Agency (ANM) system, in relation to Dam I in Brumadinho, Minas Gerais, that collapsed in 2019.

In the CGU's opinion, the declaration of stability (DCE) informed by Vale was positive, when it should have been negative, and so this constituted “an act harmful to the public administration, by hindering the mining authority’s oversight.”

According to Vale, the fine corresponds to the minimum rate provided by law, equivalent to 0.1 percent of its gross revenues for 2019.

The company added that CGU explicitly acknowledged that “Vale’s senior management was not involved in and did not tolerate the facts identified in the Administrative Accountability Process.”
