On Tuesday, the US House of Representatives passed legislation allowing the US Department of Commerce to continue applying anti-subsidy duties to products from non-market economies such as China. The bill, H.R. 4105, came as a response to a December 2011 ruling that the duties do not apply on imports from non-market economies. The House decision Tuesday followed a unanimous Senate vote in favor of overturning the December 2011 ruling Monday. The US Court of Appeals for the Federal Circuit said last December that Commerce could not apply CVD against subsidized products from non-market economies.
The American Iron and Steel Institute (AISI) voiced its support for Tuesday's ruling: "AISI celebrates the overwhelming bipartisan votes in the House and Senate in favor of legislation to overturn an erroneous federal appeals court decision denying US industry the ability to seek relief from subsidized imports from non-market economies like China. That ruling, if it had gone forward, would have put millions of valuable American jobs across many industries at risk," said AISI President and CEO Thomas Gibson.
