US ITC determination on silicon metal from Brazil and China
On January 3, 2006, the US International Trade Commission (ITC) instituted five-year reviews (“sunset”) concerning the antidumping duties on imports of silicon metal from Brazil and China. The US ITC used the sunset reviews to determine whether the revocation of the orders would be likely to lead to a continuation or recurrence of material injury to US domestic industries. As a result of these reviews, the ITC has determined that revocation of the existing antidumping duty order on silicon metal from China would be likely to lead to a continuation or recurrence of material injury to US domestic industries, but revocation of the antidumping duty order on silicon metal from Brazil would not. As a result of the ITC's affirmative determination and the US Department of Commerce's (DOC) recent affirmative finding, the existing order on imports of silicon metal from China will remain in place. On the other hand, the existing duty order on imports of the same product from Brazil will be revoked.
