US wire rod mills lose their appeal in the Court of International Trade

Today the US Court of International Trade (CIT) denied an appeal of the petitioning US wire rod mills and upheld the International Trade Commission's (ITC) preliminary negative injury determination in the antidumping investigation of carbon and certain alloy steel wire rod from China, Turkey and Germany. It was this preliminary, no injury ruling in December 2005 that terminated this particular antidumping suit against wire rod from China, Germany and Turkey. The appeal was based on technicalities involving "erroneous" information given by one of the Petitioners in their questionnaire and the petitioners' inability to comment on this questionnaire because it was received after the the briefing and comment period had ended. The Petitioners have the right to appeal CIT's ruling to the US Court of Appeals for the Federal Circuit within 60 days.
