After a quiet few years, the legislative arena is getting busy again, particularly with the freshly filed antidumping and countervailing cases.
The US International Trade Commission (US ITC) will make its preliminary injury determination in the antidumping and countervailing duty investigations of standard and structural pipe from China on the afternoon of July 20.
At this preliminary stage, an affirmative injury determination is expected, which means a reasonable indication of material injury or the threat of material injury. A positive decision will allow the US Department of Commerce (US DOC) to continue its antidumping and countervailing duty investigations.
The ITC will also make its preliminary injury determination in the antidumping investigation of steel nails from China on July 20.
The threshold for injury is low in this preliminary stage. However, there are examples, such as the wire rod case in 2005, when the commission surprised the industry with a negative injury determination and terminated the case.
