On October 24, 1997, the
US Department of Commerce (DOC) signed an agreement with the Ukrainian government for the suspension of the antidumping investigation on certain cut-to-length (CTL) carbon steel plates from
Ukraine.
Upon the request of Mittal Steel USA ISG Inc, the DOC, on December 22, 2005, initiated an administrative review of the agreement on certain CTL plates from
Ukraine for the period November 1, 2004 through October 31, 2005.
According to
US laws, the DOC has the right to review the current status of, and compliance with, any agreement by reason of which an investigation was suspended. In this case, the DOC and the Ukrainian government signed the agreement suspending the antidumping duty investigation on CTL
plate from
Ukraine.
Under the framework of this suspension agreement, all CTL
plate exports from
Ukraine are subject to export licenses by which the export levels into the
US can be controlled. Furthermore, the subject merchandise cannot be sold below the quarterly reference prices issued by the DOC.
The information submitted by the Ukrainian government indicated that each of the export licenses governed by the Agreement were at or above the quarterly FOB reference prices stipulated by the Agreement. Furthermore, data supplied by the Ukrainian government in its monthly reports indicated that
Ukraine did not exceed its annual export limits. In the preliminary results dated August 9, 2006, the DOC preliminarily determined that
Ukraine was in compliance with the agreement.
Upon receiving no comments from the interested parties, the DOC has decided not make any changes in the preliminary results. Accordingly, the final results of this review do not differ from the preliminary results.
