Mexico maintains AD/CVD duties on coated flat steel from China and Taiwan in sunset review

The government of Mexico announced that it concluded the first sunset review of coated flat steel from China and Taiwan, in temporary and permanent imports, deciding to maintain antidumping countervailing duties for five more years in a range of 22.22 to 76.33 percent until June 6, 2027.

The products with the tax are those referring to the tariff items tariff items 7210.30.02, 7210.41.01, 7210.41.99, 7210.49.99, 7210.61.01, 7210.70.02, 7212.20.03, 7212.30.03, 7212.40.04, 7225.91.01, 7225.92.01 and 7226.99.99 of the Law of General Import and Export Taxes (TIGIE), published today by the Ministry of Economy (SE) in the official gazette of the Mexican government (DOF).

In addition, also the fractions of “Eighth Rule”: 9802.00.01, 9802.00.02, 9802.00.03, 9802.00.04, 9802.00.06, 9802.00.07, 9802.00.10, 9802.00.13, 9802.00.15 and 9802.00.19 of the TIGIE. Said “Eighth Rule” is a special import permit granted by the Mexican government.

The compensatory tax was decreed by the Mexican government on June 5, 2017 and prior to its expiration, in April 2022, the companies Ternium México and Tenigal (joint venture between Ternium and Asian Nippon Steel Corporation (was formed in 2012 by the merger of the old Nippon Steel and Sumitomo Metal) requested the Economy to begin the examination of the validity of the compensatory duties.

The tax for Chinese companies is 22.22 percent for imports from Baoshan Iron & Steel Co. Ltd., 22.26 percent for imports from Beijing Shougang Cold Rolling Co. Ltd., Shougang Jingtang United Iron & Steel Co. Ltd. and Tangshan Iron & Steel Group Co. Ltd. For the rest of the exporters of coated flat steels in China, the rate is 76.33 percent.

For the company China Steel Corporation (CSC), of Taiwan, 22.26 percent and for the rest of the exporting companies in Taiwan, 52.57 percent.

According to the Ministry of Economy, in the participation of national producing companies of coated flat steel, the leader is Ternium with a market share of 56 percent, followed by Posco with 17 percent, Tenigal with 14 percent, Lamina y Placa , better known as Villacero with 3 percent, Tyasa with 1 percent.

Other producers are Grupo Industrial LM, better known by the Galvasid trademark, and Nucor-JFE Steel México. Between the two they have a 9 percent share.

The Mexican government set April 1, 2021 to March 31, 2022 as the period examined and April 1, 2017 to March 31, 2022 as the period analyzed.
