EU imposes definitive AD duty on imports of coke from China

On December 20, 2006, the European Commission (EC) initiated an antidumping proceeding concerning the imports of coke of coal in pieces with a diameter of more than 80 mm (coke 80+) from China. On September 19, 2007, the EC imposed a provisional antidumping duty on the subject product. The investigation covers the period from October 1, 2005, through September 30, 2006.

The proceeding was initiated following a complaint lodged on November 20, 2006 by three producers, representing around 40 percent of the total production of coke 80+ in the EU. The complaint provided sufficient evidence of dumping of the subject merchandise and of material injury, which was considered sufficient to initiate a proceeding.

As a result of investigation, it has been definitely concluded that during the investigation period, the average prices of imports from China undercut the average EC industry price by 5.7 percent. In the light of this findings, the provisional finding of existing of causal link between the material injury suffered by the industry and the dumped Chinese imports has been also confirmed.

Given the considerations for choosing minimum import price as the form of the measure of the EC provisional regulation on the imports of coke +80 from China are still valid and in absence of any comments against this choice, the EC decided to leave this form of measure in place. The definitive minimum import price thus calculated amounts to €192 per ton.

The amount of the definitive antidumping duty applicable for the subject merchandise has been set as the difference between the minimum import price of €197 per ton and the net CIF price in all cases where the latter is less than the minimum import price.

The regulation enters in the force on the day following its publication in the European Union Official Journal - i.e. March 18, 2008.
