In July 1990, the European Commission (EC) imposed definitive antidumping measures in the form of fixed duty per ton of silicon imported from China. On March 6, 2006, the EC received a request from the Euroalliages (Liaison Committee of the Ferro-Alloy Industry) to investigate the alleged circumvention of the AD duties imposed on imports of silicon from China. The request alleged that the AD measures imposed on imports of silicon from China were being circumvented by means of transshipments via South Korea. In response to this petition, on April 20, 2006, the EC initiated an investigation into the alleged circumvention of the antidumping measures imposed on imports of silicon from China by imports of the same products consigned from South Korea. The period of investigation is April 1, 2005, through March 31, 2006. As a result of this investigation, the EC has determined that the existing antidumping duties on silicon imported from China, should be extended to the same product consigned from South Korea, whether declared as originating in South Korea or not.
