On March 6, 2007, the Canadian International Trade Tribunal (CITT) announced that its order made on January 10, 2003 concerning hot rolled carbon steel plate imported from China, South Africa and Russia was scheduled to expire on January 9, 2008.
Under the Special Import Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of antidumping and countervailing duties expire five years from the date of the last order of finding, unless an expiry review has been initiated before that date.
Based on the comments received from the interested persons and governments, the CITT has decided that a review of the order is warranted. Accordingly, the CITT announced yesterday that it has initiated an expiry review of its order made on January 10, 2003 concerning hot rolled carbon steel plate imported from China, South Africa and Russia, and that it has also notified the Canadian Border Services Agency (CBSA), as well as other interested parties and governments, of its decision.
If the CBSA determines that the expiry of the order in respect to the subject goods is unlikely to result in the continuation or resumption of dumping, the CITT will issue an order rescinding the order with respect to those goods. If, on the other hand, the CBSA determines that the expiry of the order in respect to the subject goods is likely to result in the continuation or resumption of dumping, the CITT will then conduct an inquiry to determine if the continued or resumed dumping is likely to result in injury or retardation.
The CBSA must provide notice of its determination no later than August 23, 2007.
