US DOC initiates AD, CVD investigations on steel grating imports from China

The US Department of Commerce (DOC) has announced its decision to initiate antidumping (AD) duty and countervailing duty (CVD) investigations on imports of certain steel grating from China.

This announcement follows the June 12, 2009 decision of the US International Trade Commission (ITC) to institute a preliminary phase CVD investigation and an AD investigation against certain steel gratings from China, in response to a petition filed on May 29, 2009, by Alabama Metal Industries, Birmingham, Alabama, and by Fisher & Ludlow, Wexford, Pennsylvania.

The alleged dumping margin in these investigations ranges from 131.51 to 145.18 percent, and the subsidy rate is above de minimis (de minimis is less than one percent for developed countries or less than two percent for developing countries).

The products covered by these investigations are certain steel grating, consisting of two or more pieces of steel, including load-bearing pieces and cross pieces, joined by any assembly process, regardless of: (1) size or shape; (2) method of manufacture; (3) metallurgy (carbon, alloy, or stainless); (4) the profile of the bars; and (5) whether or not they are galvanized, painted, coated, clad or plated, and currently classified in the Harmonized Tariff Schedule of the US under item number: 7308.90.7000.

According to the ITC's fact sheet on these investigations, from 2006 to 2008 imports of steel grating from China increased 538.44 percent by volume and were valued at an estimated $90.7 million in 2008, compared to $8.9 million in 2006 and $13.7 million in 2007.

The ITC is scheduled to make its preliminary injury determination on or about July 13. If the ITC determines that there is a reasonable indication that imports are materially injuring, or threatening material injury to, the domestic industry, the investigations will continue, and the DOC will be scheduled to make its preliminary CVD determination on August 24, and its preliminary AD determination on November 5.
