On Friday, January 8, 2010, the US Department of Commerce (DOC) announced the preliminary results of its administrative review of the antidumping (AD) order against hot rolled carbon steel flat products from India.
The review covers four producers/exporters -- Essar Steel Limited; Ispat Industries Limited; JSW Steel Limited; and Tata Steel Limited -- during the period from December 1, 2007 through November 30, 2008.
The DOC has calculated a weighted-average preliminary dumping margin of 28.25 percent for Essar. This compares with Essar's current dumping duty deposit rate of 5.01 percent.
The DOC has also preliminarily decided to rescind the reviews of Ispat Industries, JSW Steel, and Tata Steel because they had no entries of subject merchandise into the United States during the period of review. Each of these companies has a current dumping duty deposit rate of zero (0.00) percent, and that rate will remain unchanged if their reviews are rescinded.
The DOC plans to complete this review by May 2010, and Essar's current dumping duty deposit rate will remain in effect until the DOC's final results are published in the Federal Register.
There is also a countervailing duty (CVD) order against hot rolled carbon steel flat products from India. The current CVD deposit rates are 76.88 percent for Essar, 15.27 percent for Ispat Industries, 484.41 percent for JSW Steel, and 27.22 percent for Tata Steel.
