Lawsuit alleges Proler Steel owes $160,000 to repair vendor

A lawsuit filed in the Houston Division of the Southern District of Texas has alleged that Proler Steel International LLC has failed to pay Liebherr Mining and Construction Equipment Inc. more than $160,000.

Court documents have alleged that Proler Steel and Newport Metal Recycling Inc. are guilty of fraud, theft and breach of contract.

According to the complaint, Proler Steel contacted the plaintiff in early 2014 to requite they repair two excavators.  When the repairs were complete, Proler Steel submitted a claim to their insurance company; during this time, Newport Metal Recycling acquired Proler Steel.  Once the insurance company evaluated the claim they cut the defendant a check for approximately $122,800 but the plaintiff was never paid.
Attorneys for the plaintiff have requested the court grant relief equal to the original cost of the repairs in addition to interest, court costs and legal fees.
