CIT decision on stainless steel wire rod imported from Italy
Following the publication of the US Department of Commerce's (DOC) final affirmative countervailing duty determination on
stainless steel
wire rod imported from
Italy, petitioners AL Tech Specialty Steel Corp, Carpenter Technology Corp, Republic Engineered Steels, Talley Metals Technology Inc and the United Steelworkers of America, AFL-CIO/CLC, along with respondents Valbruna and Bolzano, challenged the DOC's final determination before the US Court of International Trade (CIT).
CIT affirmed the bulk of the DOC's findings; however, the DOC's determination that a two-year rent abatement granted to Valbruna on its lease of an industrial site from the Province of Bolzano conferred a subsidy was remanded to the DOC for further consideration.
On October 27, 2004, the DOC filed remand results with the CIT. In the remand results, the DOC determined that a two-year lease abatement granted to Valbruna did not constitute a countervailable subsidy.
On March 9, 2005, the CIT affirmed the DOC's findings in the remand results. In line with CIT decision, the DOC will instruct Customs and Border Protection (CBP) to revise cash deposit rates and to liquidate relevant entries covering the subject merchandise effective March 29, 2005.
