WTO: EU’s AD measures against fasteners from China violated regulations

On December 3, the World Trade Organization (WTO) published a report indicating that antidumping (AD) measures imposed by the European Union (EU) on imports of Chinese metal fasteners are illegal.

According to the WTO report, the related regulations passed on December 22, 1995 by the EU to protect EU members from injury by dumping from non-EU countries and also the decision published on January 26, 2009 by the EU authorities to implement AD measures against Chinese fasteners were inconsistent with WTO regulations.

The report indicated that the EU has nullified or impaired benefits accruing to China and recommended that the European Union bring its measures into conformity with its obligations under WTO regulations.

According to WTO dispute resolution procedures, both parties can make submissions to the WTO dispute settlement mechanism and have 60 days to file appeals.
