The Court of International Trade (CIT) announced this week that it has sustained in full the US Department of Commerce's (DOC) second remand results pertaining to the fifteenth administrative review of the antidumping duty order on certain corrosion-resistant steel flat products from the Republic of Korea.
The DOC is notifying the public that the final judgment in this case—the period covered is August 1, 2007, through July 31, 2008—is not in harmony with the final results of the administrative review, and that the DOC is amending the final results with respect to the weighted-average dumping margins assigned to Union Steel Manufacturing Co., Ltd. (Union), Hyundai HYSCO (HYSCO), and Dongbu Steel Co., Ltd. (Dongbu).
On March 15, 2010, the DOC issued the final results for dumping margins as follows:
• Union: 14.01 percent
• HYSCO: 3.29 percent
• Dongbu: 8.65 percent
• Union: 14.01 percent
• HYSCO: 3.29 percent
• Dongbu: 8.65 percent
The DOC is now amending the final results for dumping margins as follows:
• Union: 9.83 percent
• HYSCO: 5.56 percent
• Dongbu: 7.70 percent
• Union: 9.83 percent
• HYSCO: 5.56 percent
• Dongbu: 7.70 percent
In the event that the CIT's rulings are not appealed or, if appealed, is upheld by a final and conclusive court decision, the DOC will instruct US Customs and Border Protection (CBP) to assess antidumping duties unliquidated entries of subject merchandise based on the revised dumping margins listed above.
