Attorneys for Nucor Steel filed an appeal dismissal Friday of their lawsuit that sought to halt construction of Big River Steel’s $1.3 billion mill in Osceola, Arkansas. The appeal would be heard by the 8th Circuit Court of Appeals in St. Louis, Missouri.

Last month, US District Judge Leon Holmes ruled that the lawsuit was not authorized under the citizen lawsuit provision of the federal Clean Air Act. Nucor, which has a competing steel mill 20 miles away from the Big River Steel site, immediately vowed to appeal the ruling.
