Final results of AD order against standard pipe from India

The US Department of Commerce (DOC) announced the final results of its administrative review of the antidumping order against welded carbon steel standard pipe and tube from India Monday.  The review covered several producers / exporters during the period from May 1, 2008 through April 30, 2009.

The DOC calculated a final weighted-average dumping margin of 6.33 percent for Lloyds Metals & Engineers Limited.

The DOC assigned the same margin - 6.33 percent - to the three other companies subject to this review: (a) Jindal Pipes Limited; (b) Maharashtra Seamless Limited; and (c) Ratnamani Metals Tubes Ltd.

The previous dumping duty deposit rates for these companies were as follows: (a)  Lloyds - 0.00 percent; (b) Jindal Pipes Limited - 77.32 percent; and (c) Maharashtra Seamless Limited and Ratnamani Metals Tubes Ltd. - 7.08 percent (the "All Others" rate).

The DOC found that the following companies made no shipments of the subject merchandise during the period of review: Lloyds Steel Industries Limited; and Universal Tube and Plastic Ind.  They remain subject to the "All Others" rate of 7.08 percent. 

Further, the DOC found that Makalu Trading Pvt. Ltd.; Ushdev International Ltd.; and Uttam Galva Steels Ltd. were resellers of standard pipe produced by Lloyds Metals & Engineers Limited.  Because Lloyds Metals & Engineers Limited knew that its sales to these companies were destined for the United States, the DOC will not assign individual margins to the three trading companies because, in its view, these companies did not have shipments of their own subject to review.  Instead, the DOC will apply the margin for Lloyds Metals & Engineers Limited to the US sales of these companies.

Accordingly, effective Monday, November 15, 2010, the dumping duty deposit rate became 6.33 percent for Lloyds Metals & Engineers Limited, Jindal Pipes Limited, Maharashtra Seamless Limited, and Ratnamani Metals Tubes Ltd.  In addition, the DOC will send instructions to US Customs and Border Protection to liquidate entries that were made during the period of review.

The product covered by these investigations is currently classified in the Harmonized Tariff Schedule of the United States (HTSUS) under item numbers: 7306.30.1000, 7306.30.5025, 7306.30.5032, 7306.30.5040, 7306.30.5055, 7306.30.5085, and 7306.30.5090.
