On August 18, 2009, the Canadian International Trade Tribunal (CITT) announced that it rescinds its findings made on July, 2004, concerning the dumping of cold drawn and annealed stainless steel round wire, up to and including 0.300 inches (7.62 mm) in maximum solid cross-sectional dimension, originating in or exported from South Korea, Switzerland and the US, and the subsidizing of goods of this description originating in or exported from India.
On November 13, 2008, the CBSA initiated an expiry review investigation to determine whether the expiry of the findings would be likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. On March 12, 2009, the CBSA determined that the expiry of the findings would be likely to result in the continuation or resumption of dumping and subsidizing of the subject goods. In the hearing held by CITT on June 9, 2009, the sole domestic producer, Central Wire Industries Ltd. (Central Wire), submitted evidence and made arguments in support of a continuation of the findings. As part of this expiry review, no parties appeared before the CITT or provided submissions in support of a rescission of the findings. An importer of the subject goods, Eutectic Canada Inc., submitted a request for product exclusion.
Following the analysis of the evidence found and comments received, the CITT has concluded that, if the findings in question are rescinded, the increase in volume and market share of dumped and subsidized goods will be minimal. Furthermore, the CITT has found that the evidence does not indicate that the likely prices of the dumped and subsidized goods will be injurious.
Therefore, the CITT has rescinded its finding in respect of the subject goods originating in or exported from South Korea, Switzerland, the US and India. In addition, the CITT has also rescinded its finding in respect of the subject goods originating in or exported from the US.
