On March 6, 2007, the Canadian International Trade Tribunal (CITT) announced that its order made on January 10, 2003 concerning hot rolled carbon steel plate imported from China, South Africa and Russia was scheduled to expire on January 9, 2008.
Under the Special Import Measures Act (SIMA), findings of injury or threat of injury and the associated special protection in the form of antidumping and countervailing duties expire five years from the date of the last order of finding, unless an expiry review has been initiated before that date.
Based on the comments received from the interested persons and governments, on April 25, 2007, the CITT initiated an expiry review of its order made on January 10, 2003 concerning hot rolled carbon steel plate imported from China, South Africa and Russia, and it also notified the Canadian Border Services Agency (CBSA), as well as other interested parties and governments, of its decision.
Accordingly, the CBSA, on April 26, 2007, initiated an investigation to determine whether the expiry of the order in respect to the subject goods is likely to result in the continuation or resumption of dumping.
The CBSA, which completed its investigation on August 23, 2007, has determined that the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods from China, South Africa, and Russia.
Accordingly, the CITT will conduct an inquiry to determine if the expiry of the order is likely to result in injury or retardation to the Canadian industry, and will make its decision by January 9, 2008.
