A Brazilian court has revoked the decision of a first instance court that had suspended earlier this year activities at the Tubarao port, in the city of Vitoria for pollution, and has approved the facility to operate normally, benefiting iron ore producer Vale and local steelmaker ArcelorMittal, which both use the port.

The port was operating under an injunction, as previously reported by SteelOrbis.

However, despite the decision that lifted the need of an injunction to allow the port to operate regularly, the court said a forensic accounting should be made within a 60-day notice to investigate Brazil’s federal police claims, which said the port was polluting the air and the sea.

The Tubarao port, located in the city of Vitoria in the state of Espirito Santo, is one of Brazil’s main ports for iron ore exports. About 35 percent of Vale’s iron ore exports are shipped from the Tubarao port.
