The Australian Customs and Border Protection Service (CBP) has partially terminated the investigation into the alleged dumping and subsidization of certain hollow structural sections (HSS) exported to Australia from China and the alleged dumping of HSS from Malaysia. The investigation has been terminated so far as it relates to the exporter, Alpine Pipe Manufacturing Sdn Bhd (Alpine), and so far as it relates to Malaysia.
The investigation was initiated on December 18, 2008 following an application by OneSteel Australian Tube Mills Pty Ltd, trading as Australian Tube Mills, and Orrcon Operations Pty Ltd. The investigation concerns the alleged dumping and subsidization of electric resistance welded pipes made of carbon steel, comprising circular and non-circular hollow sections in galvanized and non-galvanized finishes, classified under tariff subheadings 7306.30.00, 7306.61.00 and 7306.69.00 in the Australian Customs Tariff Act.
As a result of investigations covering the period January 1, 2008 to December 31, 2008, the CBP was satisfied there has been dumping by Alpine but found that the dumping margin is less than two percent.
Therefore, the investigation against Alpine is terminated. The CBP was also satisfied that the volumes of the goods that have been, or may be, exported to Australia from Malaysia over a reasonable examination period and that have been, or may be, dumped is negligible. Thus, the investigation against Malaysia has been terminated.
